Is triple talaq valid?

Question 1138

Question

If a husband says "I divorce you" three times in one sitting, is the marriage over for good, or does it count as a single divorce?

Summary of answer

The stronger view is that three divorces pronounced at once count as one revocable divorce. The Quran sets divorce in stages with time to reconcile (2:229, 65:1), and Ibn ʿAbbās reported that in the time of the Prophet ﷺ, Abu Bakr, and the first years of ʿUmar, three at once counted as one (Sahih Muslim 1472a). Ibn Taymiyya, Ibn al-Qayyim, Jaʿfari law, and the family codes of many Muslim countries take this view.

Answer

الحمد لله Praise be to Allah.

A silk and wool prayer rug with an arched niche filled with red flowering vines, framed by wide borders of woven inscription.

A husband says “talaq, talaq, talaq” in one breath, often in anger, and a whole family wakes the next morning wondering whether the marriage is gone forever. The stronger view (al-rājiḥ) is that triple talaq pronounced at once counts as a single, revocable divorce. The Quran spreads divorce over stages so that hearts have time to cool, and in the lifetime of the Prophet ﷺ three divorces said together were counted as one. A couple in this situation can still reconcile, and Allah’s law gives them the time to do it.

What does the Quran say about how divorce is pronounced?

The Quran describes divorce as something that happens in steps:

ٱلطَّلَٰقُ مَرَّتَانِۖ فَإِمۡسَاكُۢ بِمَعۡرُوفٍ أَوۡ تَسۡرِيحُۢ بِإِحۡسَٰنٖ

“Divorce is twice; then either keep her with kindness or release her with grace.”

Quran 2:229

The Arabic word marratān means “two times,” two separate occasions. After each divorce comes a waiting period (ʿidda, عدة) during which the husband may take his wife back, and only a third divorce, after two have passed, closes the door (2:230). Sūrat al-Ṭalāq adds that divorce must be given at the right time (65:1). Each step is a pause in which a family can think, talk, and bring in arbiters (4:35). Three divorces in one sentence collapse into a moment a process Allah spread over months.

How was triple talaq treated in the time of the Prophet ﷺ?

The clearest report comes from Ibn ʿAbbās (may Allah be pleased with him), the Companion most learned in the Quran’s meaning:

«كَانَ الطَّلاَقُ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم وَأَبِي بَكْرٍ وَسَنَتَيْنِ مِنْ خِلاَفَةِ عُمَرَ طَلاَقُ الثَّلاَثِ وَاحِدَةً»

“In the time of the Messenger of Allah ﷺ, of Abu Bakr, and for two years of ʿUmar’s caliphate, a triple divorce counted as one.”

Sahih Muslim 1472a

Another report tells of ʿAbd Yazīd, the father of Rukāna, who divorced his wife. When the Prophet ﷺ told him to take her back, he protested that he had divorced her three times. The Prophet ﷺ answered:

«قَدْ عَلِمْتُ رَاجِعْهَا»

“I know. Take her back.”

Sunan Abi Dawud 2196

Then he recited the opening of Sūrat al-Ṭalāq. Al-Albani graded this report hasan, though other critics weakened its chain. In another report, with a disputed chain, the Prophet ﷺ rose in anger at a man who had pronounced three divorces together and asked, “Is the Book of Allah being played with while I am still among you?” (Sunan al-Nasa’i 3401).

Why did ʿUmar count three as three?

In the same report, Ibn ʿAbbās explains what changed. ʿUmar ibn al-Khaṭṭāb said, “People have become hasty in a matter in which they were given time to reflect. What if we held them to it?” And he did.

Ibn Taymiyya (d. 1328) and his student Ibn al-Qayyim (d. 1350) read this as a discretionary measure of governance, a penalty to stop men from abusing divorce in ʿUmar’s day. Ibn al-Qayyim discusses it in Iʿlām al-Muwaqqiʿīn as a leading example of a ruling that changes with time and circumstance. A deterrent chosen for one generation cannot overrule the practice of the Prophet ﷺ, least of all when it now falls hardest on wives and children.

What do the four schools and the Shia say?

The four Sunni schools held that three divorces said at once take effect as three. Even so, the Hanafi and Maliki schools call it an innovated divorce (ṭalāq al-bidʿa, طلاق البدعة) and hold the husband sinful for it. The scholars agreed that it departs from the Sunnah.

The view that three at once count as one has deep roots. Sayyid Sabiq (d. 2000), in Fiqh al-Sunna, reported it from Companions including ʿAlī and Ibn Masʿūd and from Successors including Ṭāwūs and ʿAṭāʾ, and he judged it the more correct position. Jaʿfari (Shia) law does not count three pronouncements together as three; its prevailing view treats them as one divorce, and it requires two upright witnesses for any divorce. This is one of the questions on which Sunni and Shia jurists can meet (What is the difference between Sunni and Shia Islam?).

What do Muslim countries’ laws say today?

Modern family law has largely followed Ibn Taymiyya. Egypt’s Law No. 25 of 1929 counts a divorce pronounced with a number as a single, revocable divorce. Iraq’s Law of Personal Status of 1959 does the same. Pakistan’s Muslim Family Laws Ordinance of 1961 requires a husband to give written notice to the chairman of the local council, who convenes an arbitration council, and no divorce takes effect for ninety days. Tunisia’s Code of Personal Status of 1956 sends every divorce through a court.

In India, a five-judge bench of the Supreme Court set aside instant triple talaq by a majority of three to two on 22 August 2017, in a case brought by Shayara Bano. Parliament’s Muslim Women (Protection of Rights on Marriage) Act of 2019 then made it a criminal offense.

What should a couple do after a triple talaq?

  • Count it as one. On the stronger view, one revocable divorce has occurred. During the waiting period the husband may take his wife back; after it, the two may remarry with a new contract if both agree.
  • Use the time well. Bring in a wise relative from each side, as the Quran asks (4:35), or a counselor and an imam who follow this view.
  • Protect the wife’s rights. She keeps her mahr (What is mahr?) and receives maintenance through her waiting period. She also has her own routes out of a marriage (Can a Muslim woman divorce her husband?).
  • Put safety first. If divorce threats come with violence or intimidation, contact local emergency services or a domestic violence hotline (What does Islam say about domestic violence?).

A marriage that does end should end in the way the Quran describes: with grace, honoring the generosity that once existed between the two (Is divorce haram?).

Room for something new

Sūrat al-Ṭalāq explains why Allah gave divorce its waiting periods:

لَا تَدۡرِي لَعَلَّ ٱللَّهَ يُحۡدِثُ بَعۡدَ ذَٰلِكَ أَمۡرٗا

“You do not know; perhaps Allah will bring about something new after that.”

Quran 65:1

Words said in a moment of anger do not have the last word over a family. May Allah soften the hearts of every couple at this threshold, and grant them either a reconciliation full of mercy or a parting full of grace.

And Allah knows best. والله أعلم

Frequently asked questions

Is triple talaq valid in the Hanafi school?

The Hanafi school, like the other three Sunni schools, held that three divorces said at once take effect as three, while calling it an innovated divorce (ṭalāq al-bidʿa) and the husband sinful for it. Many Hanafi Muslims today, including in India and Pakistan, follow family laws that count it as one or require notice and arbitration.

Is triple talaq valid in Shia Islam?

Jaʿfari law does not count three pronouncements at once as three. The prevailing view treats them as one divorce, and the school requires two upright witnesses for any divorce to be valid.

Does a divorce said in anger count?

The Prophet ﷺ said there is no divorce in ighlāq (Sunan Abi Dawud 2193, graded hasan by al-Albani), which Abu Dawud explained as anger. Many scholars, Ibn al-Qayyim among them, held that words spoken in a rage that overwhelms a person's control do not end a marriage.

Is triple talaq banned in India?

Yes. India's Supreme Court set aside instant triple talaq on 22 August 2017 in Shayara Bano v. Union of India, and the Muslim Women (Protection of Rights on Marriage) Act of 2019 made it a criminal offense.

Can we get back together after triple talaq?

On the view that three at once count as one, yes. The husband may take his wife back during her waiting period, and after it ends the two may remarry with a new contract and a new mahr if both freely agree.
